The apartment is in dire need of repairs. The linoleum flooring is ripped up. There are cracks in the walls and ceilings. The apartment hasn't been painted for over 20 years. There are water stains left from leaks. I would like to fix the cracks, paint the entire apartment, replace the old kitchen cabinet & sink and put down new wood laminate flooring. I am willing to pay for the repairs and renovations because I don't want the landlord to raise my rent. Should I tell his management company of my plans or can I go ahead and do this without their knowledge? And if he finds out, will it risk my rent stabilized tenancy?
Check your lease. Typically, it will say that you need to obtain your landlord's consent for any alterations. Although unlikely, violation of the lease term may be categorized as a material breach of the lease and landlord can commence eviction proceedings. Balance this possibility vs. the reason you wish to keep any alterations secret from the landlord.
